User consent for email archiving

Hi,

I have an issue regarding data protection in the case of email archiving. According to EU law as far as I understand a company may journal an employee's emails without their consent as they are not "computer processed" however in case of email archiving the employee's consent is required as his correspondence is "computer processed" (e.g. searching, indexing, reading etc.). Recently we installed eVault journalling and archiving with the requirement that users have to accept an agreement (click on a link with the agreement and accept it) that their emails are processed in the case of email archiving. As a result most users did not bother to activate their email archiving in eVault and archive their emails on their local workstations. The company however wants to sustain a consitent approach to email archiving.

My question is: Is there a way around this legal issue in order to force users to use email archiving? e.g. include into the company policy that private emails are prohibited using the companies email service and simply automatically turn on email archiving for most users
